Ministry of Land and Resources, National Development and Reform Commission Jointly Issue Catalog of Restricted Land-use Projects and Catalog of Prohibited Land-use Projects
The Ministry of Land and Resources and the National Development and Reform Commission jointly issued the Catalog of Restricted Land-use Projects (2006) and the Catalog of Prohibited Land-use Projects (2006) recently. Being applied to the newly-built, expanded, or rebuilt construction projects, these two catalogs will become the important guides for implementing the macro-control policies and the industrial policies in the field of land supply, as well as the main measures and bases for the departments of land and resources to exert the intervention function and to control the land “gate”.
Compared with the old version of 1999, the most significant change in the new Catalog of Restricted Land-use Projects is that the following six kinds of projects are listed as restricted land-use projects, i.e., the low-density and large-area residential quarters (with the floor-area-ratio lower than 1.0 and the area of individual housing unit larger than 144 km2); the large-scale commercial facilities such as automobile trade markets, furniture markets, and construction material markets; the large-scale amusement facilities, theme parks including Movie & TV Towns, or artificial ancient cities; the racecar circuits; the public cemeteries, and the automobile training grounds. Moreover, these six kinds of projects are prohibited to occupy the arable land, nor can they acquire the arable land in the disguised form of converting in batches the agricultural land to urban construction land in advance .
The noticeable change of the new Catalog of Prohibited Land-use Projects lies in that the following six kinds of projects are added as prohibited land-use projects, i.e., the villas, golf courses, and race tracks; the new training centers built by the Party and government organizations, the state-owned enterprises, or the public institutions; the mineral resources reconnaissance without the legal right of reconnaissance; the mineral resources mining without the legal right of mining, etc.
