Standing Committee of National People’s Congress Approves Revised Law on Prevention and Control of Water Pollution
On Feb. 28, 2008, the Law of the People’s Republic of China on Prevention and Control of Water Pollution was revised and approved on the 32nd session of the Standing Committee of the 10th National People’s Congress of China and was planned to come into force on Jun. 1, 2008.
Containing 92 items in eight chapters, the Law further clarifies the local governments’ responsibilities in protecting water environment and strengthens the control over and the monitor of water pollution sources. It states that the responsibility system of water environment protection goal and the evaluation and grading system of water environment protection will be executed all over the country, taking the accomplishment of the water environment protection goals as one of the criteria for evaluating and grading the work of the local people’s governments and the officers in charge. It requires that the people’s governments above county level should bring water environment protection into national socio-economic development planning, adopting the measures of preventing and controlling water pollutions and taking the responsibility of guaranteeing the water environment quality within the respective administrative region. It also articulates that the system of discharge quantity control will be applied to some key water pollutants; for the areas where the discharge quantities of these key water pollutants exceed the control index, the administrative departments of the people’s governments in charge of environment protection should suspend the examination and approval of the environmental impact assessment documents of the construction projects which could increase the total discharge of the key water pollutants.
