Regulatory Indexes for Construction Land-use of Industrial Projects Released Lately
According to the Ministry of Land and Resources, the revised Regulatory Indexes for Construction Land-use of Industrial Projects has been released lately and formally enforced on the same day, which marked the implementation of the new regulatory indexes for construction land-use of industrial projects in China.
The revised Regulatory Indexes includes five indexes on investment intensity, floor area ratio, building coverage coefficient, the vegetation ratio, and the proportion of land-use for administrative office buildings and living service facilities, according to the which, the area of the administrative office buildings and living service facilities that an industrial project needs should not exceed 7% of the total land-use of the project, and the building coverage coefficient of the industrial project should not be lower than 30%.
In addition, the revision puts forward certain new regulations on the provision of project land-use, which clearly forbids the construction of non-production facilities like residential apartment buildings, experts’ buildings, hotels, guesthouses, and training centers. It is not allowed in principle to grow green lands within the site of industrial enterprises; yet if it is necessary to arrange certain proportion of green land because of the special production requests, the green land ratio should not exceed 20%.
Meanwhile according to the announcement of the Ministry of Land and Resources, regarding the industrial projects that are not in accordance with the Regulatory Indexes, the land provision should be withdrawn or reduced; regarding those that break the Regulatory Indexes because of the special production requests, the land provision can only be approved after thorough investigations on the practical conditions of the project to prove its reasonableness, while the legal documents and files such as the approval of land-use and the land-use contract should be reported to the administrative departments of land and resources for record. In the related documents concerning land provision for industrial projects, the requirements and regulatory indexes of land-use, i.e., indexes of investment intensity, floor area ratio, building coverage coefficient, vegetation ratio, and the proportion of land-use for administrative office buildings and living service facilities, as well as the responsibilities for contract violation should be clearly stated. Moreover, to projects who fail to fulfill the requirement of the Regulatory Indexes when completed, the related responsibilities shall be pursued based on the contract and regulations concerned.
